We do not warrant that the Service will be available, uninterrupted, or error-free.

8. Limitation of Liability

In no event shall Hyperion by GTM Delta, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless Hyperion by GTM Delta and its licensees and licensors from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising from your use of the Service or your breach of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Hyperion by GTM Delta operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
